Terms and Conditions of Service

These Terms and Conditions regulate the provision of professional consulting and training services by Luis Rivera-González, operating under the brand Luis Rivera IT Professional Services (hereinafter, "The Provider"). By contracting our services, the client (hereinafter, "The Client") fully accepts the clauses set forth herein.
1. Nature of the Services
The Provider offers specialized technical consulting services in infrastructure, SQL database administration, Healthcare IT implementation (Meditech EHR/HL7), and corporate training in productivity tools and Artificial Intelligence. The services are limited to advising, facilitating knowledge, and technical execution according to the scope defined in the service proposal or specific contract.
2. Limitation of Liability (Disclaimer of Warranties)
The Provider acts as a consultant and facilitator of technical knowledge. Under no circumstances will The Provider be liable for:
- Loss of data, service interruptions, or hardware damage resulting from the Client's pre-existing infrastructures that are deficient, obsolete, or poorly configured.
- Actions, omissions, or misuse of Artificial Intelligence (AI) tools by the Client's staff after having received the training.
- Financial, operational, or performance results that do not meet the subjective expectations of the Client, given that technical implementation depends on external factors outside the Provider's control.
3. Intellectual Property
All teaching materials, prompt guides, presentations, methodologies, and technical documentation delivered during the services are the exclusive intellectual property of The Provider. Total or partial reproduction, distribution, or resale of such materials by the Client or third parties without the express written authorization of The Provider is strictly prohibited.
4. Payments and Cancellations
The contracting of services is governed by the following financial conditions:
- Payment terms will be established in the corresponding invoice or service contract, the general rule being payment within a maximum of [X] calendar days.
- Any cancellation of workshops or consulting sessions by the Client must be notified at least 48 hours in advance; otherwise, a cancellation fee equivalent to [X]% of the service value may apply.
5. Responsible Use of AI
During training sessions, the ethical and safe use of AI is emphasized. The Client acknowledges that the final use of these tools is their sole responsibility, including the verification of results generated by language models.
6. Jurisdiction and Applicable Law
Any dispute, controversy, or claim arising out of or related to the provision of these services shall be resolved exclusively under the laws of the Commonwealth of Puerto Rico. The parties submit to the exclusive jurisdiction of the courts of the Judicial District of Mayagüez, Puerto Rico, expressly waiving any other jurisdiction that might correspond to them.
